1. Scope of Services

1.1. The Service Provider offers web design, development, and related services (“Services”) as agreed with the Client.

1.2. Specific project details, deliverables, and timelines are outlined in individual project proposals or contracts.

1.3. Any services not explicitly listed in the proposal/contract are considered additional and may incur extra charges.

2. Client Responsibilities

2.1. The Client must provide all necessary content, images, and information in a timely manner.

2.2. Delays in providing materials may affect the project timeline.

2.3. The Client confirms they hold all rights for the materials provided (images, text, logos, etc.) and indemnify the Service Provider against third-party claims.

3. Payment Terms

3.1. Project fees are defined in the proposal/contract.

3.2. Payment structure:

  • 50% deposit before project start

  • Remaining balance upon delivery / milestones

3.3. All payments are in EUR unless otherwise agreed.

4. Revisions

4.1. The project includes 4 rounds of revisions, 2 for the mood board and 2 for the Home page and remaining pages.

4.2. Additional revisions are billed at €30,- per hour or per revision, unless agreed differently.

4.3. Major changes outside the original scope (e.g., redesigning entire sections) may require a new agreement.

5. Timeline & Delivery

5.1. Project timelines are estimated and depend on timely client input

5.2. Delays caused by the Client may extend delivery dates.

5.3. The Service Provider is not liable for delays caused by third-party services (e.g., hosting providers).

6. Intellectual Property

6.1. The Service Provider retains copyright of all preliminary designs and materials until full payment is received.

6.2. Upon full payment, rights to the final website/design are transferred to the Client, unless otherwise agreed.

6.3. The Service Provider may use the work for portfolio and promotional purposes, unless the Client requests otherwise in writing.

7. Liability

7.1. The Service Provider is not liable for indirect, incidental, or consequential damages arising from the website use.

7.2. The Client is responsible for backups, data protection, and compliance with applicable laws regarding website content.

8. Confidentiality

8.1. Both parties agree to treat confidential information received during the project as private.

8.2. Confidential information does not include information already publicly available or independently developed.

9. Termination

9.1. Either party may terminate the agreement with written notice.

9.2. Fees for work completed up to the termination date are non-refundable.

9.3. The Service Provider may terminate the project if the Client fails to meet obligations, including payment and provision of materials.

10. Governing Law & Dispute Resolution

10.1. These T&Cs are governed by the laws of Portugal.

10.2. Any disputes shall be resolved through good faith negotiation; if unresolved, the courts of Portugal will have jurisdiction.

11. Amendments

11.1. The Service Provider may update these T&Cs from time to time.

11.2. The Client will be notified of significant changes prior to applying them to active agreements.
